SC DECLARES THAT MARITAL INFIDELITY IS A GROUND FOR VAWC SPECIFICALLY PSYCHOLOGICAL VIOLENCE

The Supreme Court has declared the conviction of a man for violation of RA 9262 which states that a man who cohabited with another woman and impregnated the same while his wife was working abroad. Further, it is emphasized that the man’s act constitutes marital infidelity which is one of the forms of psychological violence. Furthermore, the Court ruled that the prosecution was able to establish the petitioner’s marital infidelity, the petitioner’s cohabitation with another woman who even bore him a child, and the petitioner’s abandonment of his wife.
